Abstract

The present study draws attention to the relevance of the indirect evidence, recognized as a sort of legitimate evidence by Article 239 from the Procedure Criminal Code, having the same force of assessment as a direct evidence. The evidence is indispensable to combat the impunity of criminal agents, on whom the benefit of the doubt prevails, generally due to facts of difficult evidence, especially in the examination of the subjective element in white-collar crimes. In the end, we list some examples of more frequent evidence in the routine of fighting corruption through fraud in bidding.
