Abstract

This paper proposes an analysis of the reduction in the offer of night classes in the city of Manaus in view of the constitutional provisions and principles related to education. Therefore, the deductive approach method, of the general character of the constitutional rule, was used to apply it to the specific case, using the monographic procedure and the case study, and, as a research technique, to indirect documents, through bibliography and documentary research. In conclusion, the municipality cannot use of administrative discretion not to offer this modality of education, as it is an individual right unavailable.
