Abstract

The purpose of this research is to answer the following question: is the PL 6.268/2016 incompatible with the constitutional provisions about environmental protection? To answer this it is necessary to analyze questions that involve the creation and development of the referred PL, identify which are the possible juridical and environmental consequences if hunting becomes regulated in Brazil and, finally, verify if there is compatibility between the constitutional protection of the environment and the “Política Nacional de Fauna”. This research was made using qualitative approach based on interpretation of literature about the theme, analysis of the laws and positive and negative arguments. It was possible to conclude that the PL 6.268/2016 is not in harmony with the brazilian legal order needing, because of that, to be made a review so it does not threat a fundamental right: the right of an ecologically healthy and balanced environment.
