Abstract

Criminal Law exists as the ultimate mechanism, focused at safeguarding the dearest legal assets of society. Within this, the figure of the psychopath gains prominence, in that it has a profile prone to challenging the laws and is especially resistant to the modification of such behavioral pattern. Thus, using as basic methodologies the bibliographic and documentary research, this work aspires: 1. to analyze possible state responses to the delinquency behavior perpetrated by psychopaths, in the current Brazilian juridical-normative conjuncture; 2. to verify whether possible answers are compatible with the scientific knowledge about the characteristics of these persons. As a result it was possible to conclude: 1. for the imputability of psychopaths, according to the criteria adopted by the Penal Code; 2. for the imposition of penalties as a more adequate response for this type of offender, although still ineffective in order to, by themselves, prevent their recidivism.
