Abstract

Identifying the influence of post-World War II functionalist theories on criminal law, this scientific article analyzes the effects of Claus Roxin’s teleological functionalism on criminal dogmatics, centering its efforts on the study of the third element of the systematic concept of crime. In order to do so, through a bibliographic review, it initially investigates the circumstances of the emergence of functionalist theories in criminal sciences; afterwards, it analyses Claus Roxin’s functionalist model, identifying the essential functions of the criminal system and its consequences on the outlining of punishment purposes. Finally, it studies the modifications generated by this theory on criminal dogmatics, especially on the passage from the finalist concept of culpability to the functionalist concept of responsibility.
