Abstract

The present work is intended to study the mafia-type criminal associations in Italy, and more specifically to “Cosa Nostra”, the most powerful mafia organization in Palermo, Sicily. To this effect, the work begins with a brief evolutive analysis on the territorial, political and socioeconomic characteristics that favored the emergence of the mafia in Italy. Then, the object of study is delimited, defining the crime of criminal association of the mafia type, differentiating it from related categories through its peculiarities, according to criteria that influence the study of the cumulation of agents, such as the method mobster and the “omertà”. Related offenses (end-offenses) are also studied from the perspective of their substantive grounds, in particular extortion, usury, corruption and money laundering. Finally, a study is made of the initiatives of the institutions responsible for investigation and prosecution to strengthen prevention and prosecution of mafia activities, with emphasis on the abduction and confiscation of their assets, exposing and assessing the challenges. facing the globalization of the activities of these associations.
