Abstract

The thematic approach raised in this study turns to the analysis is of the preventive detention of women both from the judicial negotiations that this issue receives in Brazil and from its understanding by the Inter-American System of Human Rights. While the Inter-American Human Rights System pursues this discussion, with the appropriate expertise, in order to encourage female imprisonment be conditioned by a gender perspective, Brazil faces serious problems to envisage the prison issue from this perspective, extending and applying it without distinction, even when the execution of pre-trial detention is in vogue. It is in this context that an analysis is of the application of pre-trial detention to women is carried out in the light of what the SIDH designates, both as recommendations incorporated in its reports on the applicability of pretrial detention, and also in the jurisprudential perspective surrounding the thematic.
