Abstract

The present work is about the untying of the judge to request for acquittal of the defendant argued by prosecutors in criminal action. In 172 order to see if the manifestation of the Public Ministry for acquittal of the defendant in criminal action binds the public magistrate, from the clash article 385 of the code of criminal procedure, the accusatory system. Use of theoretical research, especially the media, documentary and bibliographic jurisprudential, proposing to study the role the public prosecutor and the limits of your expertise in criminal proceedings and study the linking of the judge in the face of manifestation for acquittal of the Public Ministry, from the perspective of doctrinal antagonistic currents.
