Possibility of judicial intervention in the crisis of the penitentiary system

Abstract

The current chaotic scenario of the brazilian prison system has brou­ght extremely damaging consequences to society. The failure of the State to implement efficient public policies for the reform and construction of prisons is a determining factor for the violation of numerous fundamental social rights inscribed in the Constitution. The supposed scarcity of finan­cial resources, a manifestation of the notorious “reserve of the possible,” can not be used as a protective shield to house the persistent debauchery of public managers. Neo-constitutionalism shows that discretion in the exercise of power is not absolute, since it is limited by the Constitution, notably by fundamental rights. The Democratic and Social State of Law demands a positive action from the Public Power to effect social rights, ensuring the basic conditions of survival to safeguard the dignity of the human person. The State must protect and promote fundamental social rights, failing which it will be subject to judicial intervention with the aim of ensuring adequate and efficient protection.
