Abstract

Dworkin's critique of positivism in Law's Empire is defined by defending the impossibility of making neutral and descriptive judgments of legal practice using the participant's perspective as a reference. This article aims to briefly and precisely clarify Wil Waluchow's response to this challenge based on the work Inclusive Legal Positivism. Through bibliographic research, it is concluded that legal research, according to Waluchow, can be carried out through meta-theoretical values such as clarity and simplicity. From these values, then, it would be possible to carry out valuations within the internal perspective without necessarily being political or justifying.
