Abstract

International contracts are a real transformation in private relationships and are increasingly present in the daily lives of large cities. Thus, the general scope of the present work is to examine the main characteristics of international contracts so that it is possible to understand their legal concept and their main elements. As a specific objective, it seeks to analyze the autonomy of the parties’ will and how this principle can be affected by domestic law and private international law. To this end, research of doctrinal and legal instruments, national and international, in particular from Brazil, from the Organization of American States and the European Union, are carried out, in order to highlight what is the understanding about the autonomy of the parties’ will in international contracts. Finally, the discussion about the interpretation of Article 9 of the Law of Introduction to the Rules of Brazilian Law and what consequences reverberate for the development of Private International Law in Brazil is brought up.
