Abstract

This article proposes to address some of the functions of the prosecutor in oral proceedings. It addresses certain issues that we consider to be insignificant in its preparation and to implement views with some flexibility, which does not mean that they are entirely new, but from praxis looking from a renewed perspective. Prosecutors tra­ditionally confront oral judgment according to individual preparation that each one has and he relied heavily on knowledge of the summary or preparatory phase of the oral judgment, considering that domi­nance is the supreme key to success, which is not entirely distant of reality, but not enough needs scientific strategies and knowledge. The stage of the debate in the oral proceedings takes place, among other procedures, on the basis of the practice of the evidence proposed by the parties and this supposes that a successive rearrangement of the theses of both parties occurs constantly, because new elements of evidence appear that substitute already existing ones and Logically they also replace the previous criterion of the judges with a new one, which in turn can be replaced by a new one depending on the circumstances of the perception.
