Abstract

This article aims to analyze the legality and effectiveness in the utiliza­tion of, electronic monitoring as a substitute for imprisonment. Moreover, as a form of compliance with a penalty or a precautionary measure, established by the axiological analysis of the Criminal Code, Criminal Procedure Code and Laws n. 7.210 / 84 and 12.258 / 2010 against doctrine, jurisprudence. In addition to the experiences of detainees and prisoners who currently use or have used the devices available today, as well as its strengths and weaknesses. As a methodological basis of the study, we used previous studies on the subject, statistical data from SEJUS in the State of Ceará and other similar surveys from different locations. In the end, this article analyzes the future of non-prison sentences and the need to modernize legislation concomitant with technological advances, and concludes that effective resocialization is the most important aspect of prison and criminal execution.
