Abstract

The public procurement process comprises three important phases: planning, selection of the best proposal, and contractual execution. The new process vision centralizes that planning is the most important step, since all others will be conditioned to the correct and adequate description of what’s intended to be contracted. Otherwise, inadequate planning results undesirable incidents, such as unnecessary contractual additions, emergency contracting resulting from degrading or mismanagement, among other arbitrary practices and harmful to public money. This article presents a study about main aspects inherent in the public procurement process. The methodology used was based on a survey of 83 Revista Acadêmica Escola Superior do Ministério Público do Ceará current legislation, as well as the best practices recommended by the doctrine and jurisprudence. Through the present study, it’s inferred that it is necessary to recognize the importance of planning in the public procurement process, since it makes possible the good management of public resources, through prevention of failures and suppression of uncertainties.
