Abstract

This study aims to analyze the problem of the imprisoned women and motherhood with sons and daughters in brazilian female prisons. The issue focuses on maternal imprisonment, demonstrating how the invisibility of this group impacts on the life of the imprisoned mother and her children. To this end, decisions of the Supreme Federal Court, Superior Court of Justice and will also be analyzed, the legislation that regulates the issue, scientific papers, data presented by agency reports for the purpose of reflecting on the situation they are, what are the progress and the difficulties. The results of the study demonstrate that there is non-correspondence between the normative tools that guide the institutional actions and the reality experienced by the imprisoned mother, and it is necessary to think about alternative measures to the prison to fulfill the human dignity.
