Abstract

This article aims to analyze environmental responsibility from understanding the foundations and legal instruments used to avoid environmental damage. Therefore, intends to examine the legal foundations of environmental responsibility; objective, supportive and integral civil liability; police power and administrative sanctioning; and an overview of the subsidiarity of criminal law and the extension of criminal liability. The general objective is to present the foundations and legal instruments 193 Revista Acadêmica Escola Superior do Ministério Público do Ceará of Brazilian law used to prevent environmental damage, specifically to provide an overview of how legal responsibility occurs in civil, administrative and criminal fields. The methodology used is bibliographical research from the analysis of doctrinal and legal concepts. At the end, it is intended to provide answers about the legislative effectiveness of responsibility for environmental damage to help the understanding of the theme to its full extent.
