Abstract

This article analyse the culpability passing through the avaliation of the coculpability theory in it’s strands. When we analyse that theory we look forward to verify it’s adequation to the social tissue and the viability to adjust in the penal law in the criminal sanction. Done that, the article focus the attention in the upside down coculpability, once that if the coculpability fundaments in the agent privation of the constitutional obligations it would be (in) correct to avaliate the possibility of applying a more severe sanction when the agent, despite many opportunities to develop its potential as human being decides to commit criminal violations. In this perspective we sustain that the co-culpability in reverse demands a legal modification, which was treated in this article. In summary, to elucidate the role of this figures inside the sanction theory is the goal of this article.
