Abstract

The obscurity of the legislation regarding the appropriateness of the unlimited consensual suspension of the enforcement process for payment in installments of the food debt, when the procedure adopted allows the civil debtor to be imprisoned, prompted the reflection carried out through a qualitative approach, using an inductive method. When weighing the constitutional principles involved — the life of the student and the freedom of the student — and the application of the special rule of proportionality, it was possible to understand the moment when the suspension of the food enforcement process removes the urgency that legitimizes the decree of the prison maintenance debtor.
