Abstract

The Judiciary is required to have a constant accountability in its activity, which is perfectibilized through the presentation of adequate reasons for its decisions. The judge plays an important social role, and must observe compliance with the objectives of the Republic provided in art. 3º of the Constitution. In order to provide an adequate rationale, several variables must be considered, especially those related to the costs of rights. In this sense, the study of the theory of Cass Sunstein and Stephen Holmes is fundamental, which will be done through a methodology directed eminently to the bibliographic revision of the work the Cost of Rights, contrasting it with the Brazilian reality. All rights are positive and require an affirmative response from the State, and there are no absolute rights. The issue of the costs of rights deserves special attention, and although this is not the primary issue, it can not be ignored.
