Abstract

This paper aims to discuss briefly the interference of the Judiciary in the pursuit of public policy in the Brazilian prison system, given decisions by the Federal Supreme Court, which recognized the State of Things Unconstitutional. In these terms, it was tried to analyze the possible breach of the principle of the separation of powers, in view of the preponderant action of the Judiciary.
